A car owner in Michigan has sued for the accidentally killed mechanic

A Michigan man is suing for the death of a mechanic because he simply brought his jeep to a saloon to change the oil.

In March 2020, Sergio Enrique Diaz-Navarro brought his 2019 red Jeep Wrangler to the Chrysler Jeep Dodge Rochester Hills showroom for an oil change. Unfortunately, a tragic event occurred during a car service call.

Daniel Thompson, 19, was working on a Diaz-Navarro jeep on March 13, 2020, when the vehicle “leaned forward,” crushing 42-year-old mechanic Jeffrey Hawkins on a cabinet, according to court records.

“Thompson reached into the vehicle and pressed the brake with his right foot, keeping his other foot on the floor,” court documents said. “He pressed the start button. When the vehicle didn’t start, he took his foot off the brake and pressed the clutch pedal. He pressed the start button again. This time the Jeep started. He removed his foot from the clutch, still standing outside the vehicle. The vehicle jerk forward. “

Thompson allegedly did not have a driver’s license and did not know how to drive a manual transmission.

Hawkins – the father of four children – has died in a tragic accident.

“I started the engine, removed the clutch, and then a terrible thing happened – the car had lunch and killed my client,” lawyer David Femminineo – who represents the Hawkins’ estate – told WJBK.

Despite Diaz-Navarro not being behind the wheel or near his own vehicle during the fatal event, the family of the deceased victim is suing him for negligence. The Hawkins family expects to receive more than $ 15 million in damages from the car owner who was not present at the time of the fatal crash.

Femminineo admitted: “We can’t (sue the agency) because of the legal standard involved.”

The lawyer said the agency cannot be sued for a legal standard that prevents an employee from suing his boss for negligence.

The Washington Examiner reported: “Diaz-Navarro is held accountable for giving keys to lawmakers because of a replacement state liability law that holds owners automatically responsible for driver negligence – a principle that could be extended to mechanics, maid attendants and others.”

Diaz-Navarra insurance company has already paid $ 100,000 for the unfortunate death.

Diaz-Navarra’s lawyer said: “When you hand over your car to anyone, including a valet or a service person at your local dealership, it is better that you can trust that person.”

Carscoops reports: “The agency is not getting away with it, though. The court has ordered Rochester Hill’s Chrysler Dodge to indemnify Diaz-Navarro if found guilty of negligence.”

“So, in reality, the owner will bear the responsibility, but the insurance company pays the dealership,” Femminineo told the Kansas City Star. The agency is expected to appeal the decision if it is held responsible for the death.

A lawsuit against Diaz-Navarro is set to begin in late May.
